1. Acceptance of Terms
By downloading, installing, or using the OtherTreasure mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms apply to all users, including those who post items ("Givers") and those who collect items ("Finders").
2. Description of Service
OtherTreasure is a community platform that enables users to offer and discover free items from nearby neighbours. The App acts solely as a facilitation tool. We are not a party to any exchange, transaction, or interaction between users and do not guarantee the availability, quality, legality, or safety of any item listed.
3. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you represent that you have permission from a parent or legal guardian. We may request proof of such consent.
4. User Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity under your account.
- You must provide accurate and truthful information.
- You may sign in using Google, Facebook, Apple, or email/password. Their respective terms apply.
- We reserve the right to refuse or reclaim usernames.
5. Listings & User Content
- All items must be offered completely free. No payment, barter, or compensation is allowed.
- You may only post items you own or have the right to give away.
- Listings expire automatically after 48 hours.
- If you list food or other edible items, you must comply with applicable laws and provide accurate, not misleading information about the item, including known ingredients, allergens, expiry or best-before date, storage conditions, and whether the item is sealed, opened, homemade, or perishable, when relevant.
- You retain ownership of your content. By posting, you grant OtherTreasure a non-exclusive, worldwide, royalty-free licence to display and distribute your content within the App for the purpose of operating the service.
- You are solely responsible for the legality, accuracy, and safety of your listings.
6. Prohibited Content & Conduct
You agree not to post or engage in:
- Illegal, dangerous, or regulated items (weapons, drugs, recalled products, etc.).
- Hazardous materials or items posing safety risks.
- Food or drink that is expired, spoiled, contaminated, recalled, improperly stored, unlawfully labeled, unsafe for consumption, or presented with false or incomplete safety information.
- Defamatory, hateful, harassing, or infringing content.
- Spam, duplicate listings, or commercial advertising.
- Attempts to hack, reverse-engineer, or disrupt the App.
- Using the App for commercial or for-profit purposes.
- Impersonating another person or entity.
- Circumventing listing rules or safety features.
We may remove any content at our discretion, including any food listing that appears unsafe, unclear, suspicious, mislabeled, or otherwise inappropriate for the platform.
7. Safety & In-Person Interactions
OtherTreasure does not screen, verify, inspect, test, or endorse users or items, including food listings. You are solely responsible for your personal safety when meeting others or collecting items. If you choose to give or receive food, you do so entirely at your own risk, including risks related to allergens, contamination, spoilage, mislabeling, preparation, storage, transport, and fitness for consumption. Use caution, meet in public places, and follow local safety guidelines. We are not responsible for any harm, loss, theft, illness, allergic reaction, or injury arising from user interactions or exchanged items.
8. Location Data
The App uses your device's location to show nearby listings and confirm proximity when marking items as taken. Location is used only while the App is in the foreground. See our Privacy Policy for full details.
9. Intellectual Property
All original content, design, logos, and code of OtherTreasure are owned by or licensed to us and protected by applicable laws. You may not copy, reproduce, or create derivative works without written permission.
10. DMCA / Copyright Complaints
If you believe content infringes your copyright, you may submit a takedown request to: othertreasuremarketing@gmail.com. We will respond in accordance with applicable law.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, accuracy of listings, safety, legality, quality, merchantability, fitness for a particular purpose, or condition of items, or identity or behaviour of users. We do not verify ingredients, allergens, expiry dates, labeling, preparation methods, storage conditions, or food safety compliance for edible items. You use the App, and any item obtained through it, entirely at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, OtherTreasure and its operators shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the App or items exchanged through it, including claims involving food safety, spoilage, contamination, allergens, mislabeling, illness, or other injury. Our total liability shall not exceed the amount you paid to use the App in the 12 months preceding the claim (which is zero).
13. Indemnification
You agree to indemnify and hold harmless OtherTreasure, its owners, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- your use of the App
- your interactions with other users
- your listings or content
- any food or edible item you list, give away, describe, prepare, store, transport, or receive through the App
- your violation of these Terms
14. Termination
We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or for any other reason. You may delete your account at any time via the App or by contacting support.
15. Modifications to the Service
We may modify, suspend, or discontinue any part of the App at any time without liability.
16. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated via in-app notice or by updating the "Last updated" date. Continued use of the App constitutes acceptance.
17. Governing Law
These Terms are governed by the laws of [insert country/state], without regard to conflict-of-law rules. Any disputes shall be resolved exclusively in the courts located in [insert location].
